DMCA Notice & Takedown Policy — Digital Momy

This page explains how to report alleged copyright infringement on Digital Momy (the “Site”) and how we handle such notices. This Policy is provided for transparency and does not constitute legal advice.

1) Reporting alleged infringement (DMCA notice)

If you believe material on this Site infringes your copyright, send a written DMCA notice to our DMCA Agent including all items below (17 U.S.C. § 512(c)(3)):

  1. Signature of the copyright owner or authorized agent (electronic or physical).

  2. Identification of the copyrighted work claimed to be infringed.

  3. Identification of the material you claim is infringing and its location (URL) on our Site, sufficient for us to locate it.

  4. Your contact information (name, email, and preferably address/phone).

  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.

  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner’s behalf.

2) Our response

Upon receiving a valid notice, we may remove or disable access to the material and make a good-faith attempt to notify the party who posted or controls the material (if applicable).

3) Counter-notification

If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notification containing:

  1. Your signature (electronic or physical).

  2. Identification of the material removed and its prior location (URL).

  3. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.

  4. Your name, address, phone, and email, and a statement that you consent to the jurisdiction of the Federal District Court for your address, or if outside the U.S., to any judicial district where the service provider may be found, and that you will accept service from the original complainant.

If we receive a valid counter-notice, we may restore the material unless the original complainant notifies us that they filed a court action within the time required by law.

4) Repeat infringement

Where applicable, we may restrict or block access by parties we reasonably determine to be repeat infringers.

5) Misrepresentations

Under 17 U.S.C. § 512(f), parties who knowingly misrepresent claims in a notice or counter-notice may be liable for damages (including costs and attorneys’ fees).

6) No legal advice / changes

This Policy is for information only and may be updated. Posting a new effective date constitutes notice of changes.
