These Terms of Use (“Terms”) govern your access to and use of this website (the “Site”) operated by Digital Momy. By using the Site, downloading files, or subscribing to emails, you agree to these Terms and to our Privacy Policy and License (Personal Use Only).

These Terms are a general template and not legal advice.

1) What we offer

Digital Momy provides free personal-use graphics (e.g., PNG clipart, 12×12" seamless patterns, coloring pages) and blog content. Files are provided “as is” for non-commercial creative projects.

2) Personal-Use License (summary)

When you download any file from the Site, we grant you a limited, non-exclusive, non-transferable, revocable license to use it for personal, non-commercial projects only.
Not allowed: reselling or redistributing files; claiming them as your own; uploading to marketplaces (Etsy, Creative Fabrica, Redbubble, Amazon, etc.); using on merchandise, POD, or for client/paid work; compiling our files in packs; hotlinking or re-hosting downloads.

3) Intellectual property

All Site content—including images, graphics, text, and layout—is owned by or licensed to Digital Momy and protected by copyright and other laws. No rights are granted except those expressly stated in these Terms and in the License.

4) Acceptable use

You agree not to:

Use the Site or files for illegal, harmful, or commercial purposes.
Bypass technical measures; scrape or mass-download using bots; mirror or frame the Site.
Remove copyright notices or metadata.
Interfere with Site security or other users’ access.

We may limit or revoke access if we believe these Terms are violated.

5) Accounts, newsletter & “subscribe to unlock”

If you subscribe or use “subscribe to unlock” features, you must provide accurate information and keep it secure. You can unsubscribe at any time. Our handling of personal data is described in the Privacy Policy.

6) Third-party links, ads & affiliates

The Site may display Google AdSense ads and contain affiliate links (e.g., Etsy, Creative Fabrica). We may earn a commission if you purchase through those links at no extra cost to you. We are not responsible for third-party websites, products, or policies.

7) DMCA / copyright complaints

If you believe any content infringes your copyright, please email digital.momyart@gmail.com with:
(1) your contact details, (2) identification of the copyrighted work, (3) the URL of the allegedly infringing material, (4) a good-faith statement of ownership, and (5) a statement that the information is accurate, made under penalty of perjury. We may remove content at our discretion.

8) Disclaimer of warranties

The Site and all files are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, and availability. Download and use files at your own risk.

9) Limitation of liability

To the maximum extent permitted by law, Digital Momy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits arising from your use of the Site or files.

10) Indemnification

You agree to indemnify and hold harmless Digital Momy from any claims, damages, liabilities, and expenses arising from your breach of these Terms or improper use of the Site or files.

11) Geographic scope & age

The Site is intended for users 13+. Access may not be legal in some jurisdictions; you use the Site at your own initiative and are responsible for compliance with local laws.

12) Changes to the Site and Terms

We may modify or discontinue any part of the Site at any time. We may update these Terms by posting a new date at the top. Your continued use after changes means you accept the updated Terms.

13) Governing law & disputes

These Terms are governed by the laws of Chile, without regard to conflict-of-laws rules. Any disputes will be resolved in the courts of Santiago, which shall have exclusive jurisdiction. If any provision is unenforceable, the rest remains in effect.
